Terms of Service

1. Acceptance of Terms

By accessing and using MinuteMayhem ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service. MinuteMayhem reserves the right to update and change these Terms at any time without notice. Your continued use of the Service following the posting of revised Terms means you accept and agree to the changes.

2. Eligibility

You must be at least 18 years of age to use MinuteMayhem. By registering and using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts. If you are under 18, you may not use this Service.

Parents using MinuteMayhem must be the legal guardians or have proper authorization to arrange childcare for the children in their account. Sitters must be legally authorized to work and provide childcare services in their respective jurisdictions.

3. User Accounts

When you create an account on MinuteMayhem, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account information and password and for all activities that occur under your account. You agree to notify MinuteMayhem immediately of any unauthorized use of your account.

You agree that you will not allow any other person to use your account and that you are responsible for all activity conducted through your account. If you are a parent, you are responsible for supervising any caregivers hired through the Service.

4. Marketplace Role

MinuteMayhem operates as a marketplace platform that connects parents seeking childcare services with independent sitters. MinuteMayhem is not a childcare provider, employment agency, or employer. We facilitate connections between parents and sitters but do not control, supervise, or direct the actual provision of childcare services.

Sitters are independent contractors, not employees of MinuteMayhem. Parents are responsible for evaluating sitters, conducting interviews, checking references, and making their own hiring decisions. The relationship between parents and sitters is direct and independent of MinuteMayhem.

5. Booking & Payments

All payments on MinuteMayhem are processed securely through Stripe, our third-party payment processor. By making a payment, you authorize Stripe to charge your provided payment method.

Platform Fee: MinuteMayhem charges a 15% platform fee on all sitter earnings. This fee is deducted from the sitter's payment and covers our operational costs, including customer support, background check facilitation, and platform maintenance.

Payments to sitters are processed weekly. Sitters must have a valid bank account and tax identification information on file to receive payments. Parents are responsible for understanding their payment terms and ensuring funds are available before booking.

6. Cancellation Policy

Parent Cancellations: Parents may cancel bookings up to 24 hours before the scheduled start time with a full refund. Cancellations made less than 24 hours before the start time will result in a 50% charge to the parent. No-shows without cancellation will be charged in full.

Sitter Cancellations: Sitters who cancel confirmed bookings less than 24 hours before the scheduled time may face penalties, including suspension or removal from the platform, depending on the frequency and circumstances of cancellations.

MinuteMayhem reserves the right to modify cancellation policies at any time, with notice provided to users.

7. Background Checks

MinuteMayhem requires all sitters to pass a background check before they can accept bookings. The background check includes criminal history and may include other screening measures as determined by MinuteMayhem.

The background check process is conducted by a third-party provider. MinuteMayhem does not guarantee that background checks will identify all disqualifying information. Parents are encouraged to conduct their own due diligence and interviews before hiring a sitter.

If a sitter fails a background check or if new information comes to light after a sitter is active, MinuteMayhem reserves the right to suspend or terminate the sitter's account.

8. User Conduct

You agree not to engage in any conduct that is illegal, abusive, threatening, defamatory, obscene, or otherwise objectionable. Specifically, you agree not to:

• Harass, intimidate, or threaten other users
• Post or transmit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material
• Impersonate any person or entity or misrepresent your identity
• Engage in any fraudulent activity or misrepresentation
• Attempt to gain unauthorized access to the Service or another user's account
• Reverse engineer, decompile, or otherwise attempt to discover the source code of the Service
• Bypass or circumvent the safety features of the Service

MinuteMayhem reserves the right to investigate any suspected violation of these terms and to take appropriate action, including suspension or termination of your account.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINUTEMAYHEM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

MinuteMayhem's total liability to you for any claim arising out of or relating to the Service shall not exceed the amount paid by you to MinuteMayhem in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

10. Termination

MinuteMayhem may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that MinuteMayhem determines, in its sole discretion, to be harmful to the Service, other users, or MinuteMayhem.

You may terminate your account at any time by contacting MinuteMayhem support. Upon termination, your right to use the Service will immediately cease. Any outstanding payments or balances due will remain your responsibility.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MinuteMayhem operates, without regard to its conflict of law provisions. You agree that any legal action or proceeding related to these Terms or the Service shall be brought exclusively in the courts of that jurisdiction.
